Standard terms and conditions for landlords / landladies

1. You assign the agency fine + mine to sublet your flat/house and to offer it to prospective customers. Fine + mine publishes photographs, sketches and descriptions and enables the contact between the owner/landlord and the prospective customer.

For you as a landlord/landlady the service of fine + mine is free of charge, if there is no agreement about special services. If the landlord is not the owner, permission for subletting by the owner is needed. This permission is presupposed by fine + mine. If it comes to complications by an unauthorized offer, fine + mine is justified to charge you for expenses.

2. You commit yourself to inform fine + mine immediately as soon as it comes to a letting or if the customer extends the agreed renting period. Likewise there is a duty to inform fine + mine, if a former customer contacts you directly to rent the flat.

You commit yourself to communicate the name of the tenant to fine + mine, no matter whether the tenant is through fine + mine or not. In addition there is a duty to supply information if data of the offer change (in particular data concerning the period of time, price and equipment). There is also a duty to inform fine + mine if you will not be present for a longer period of time or if the flat is not to rent anymore.

It is to be noted that with a promise of letting your place a contractual agreement is entered. If one withdraws from this promise, claims of the tenant might occur.

3. If you assign a third person with duties, this person has got the duty to supply information to us.

4. You are able to quit the arrangement at any time. Obligations under 2. remain unaffected by it.

5. Not fulfilling these duties under 2. and 3., fine + mine can charge a penalty of 50,00 euro. Other claims for damages remain unaffected by this.

6. The flat agency fine + mine only appears as an intermediary. Despite all care fine + mine cannot take over adhesion for possible damages to the dwelling or disadvantages by the letting or by breach of contract.

7. Place of jurisdiction is Berlin.
